Tier 2 : Helpful hints for candidates

  • A candidate holding a valid Certificate of Sponsorship under Tier 2 may still be refused entry clearance on other grounds (for instance a poor immigration history)

  • All documents submitted in support of entry clearance and in-country applications under Tier 2 must be originals rather than copies

  • Any document which is not in English/Welsh must be accompanied by a fully certified translation by a professional translator

  • Applications may be refused outright if any required documents are omitted from the case

  • Entry clearance must be arranged prior to arrival in the UK and the application must include a valid Certificate of Sponsorship reference number

  • Entry to the UK is permitted up to 14 days before the employment start date recorded on the Certificate of Sponsorship, at the earliest

  • The candidate must be at least 16 years old at the time the application is completed

  • If the Sponsor is a limited company then the candidate must not own more than 10% of its shares

  • Tier 2 candidates and their dependant family members are not allowed any recourse to public funds whilst in the UK

  • The candidate and any accompanying dependants over the age of 16 years, must register with the UK Police if this is required (generally this only applies to nationals of certain countries)

  • The candidate must undertake the employment specified on the Certificate of Sponsorship, any changes to the role (i.e. duties and responsibilities, salary, location) must be properly declared to the UK Border Agency

  • The candidate may take supplementary work and engage in voluntary work providing it does not impact on their main role in the UK
