Tier 2 – Permanent Cap
The introduction of the 'permanent cap' brought with it the implementation of an annual limit on the number of Certificates of Sponsorship that may be awarded to overseas nationals seeking entry clearance to the UK under the Tier 2 (General) category. The limit for April 2011 to April 2012 has been set at 20,700, referred to as 'restricted' Certificates of Sponsorship.
However to minimise the impact of the changes on existing migrants, those candidates already residing in the UK and applying to extend or switch their status to Tier 2 (General) do not form part of the annual limit. It is possible for UK sponsors to assign 'unrestricted' Certificates of Sponsorship to candidates applying for leave to remain in the UK under Tier 2 (General).
In addition, there is no limit applied to posts attracting a salary package of £150,000 or more and sponsors may issue 'unrestricted' Certificates as required.
The UK Border Agency has put strict policies in place to manage and monitor the issuance of unrestricted Certificates of Sponsorship, advising that consideration will be given to withdrawing Tier 2 sponsor licences where sponsors have been found assigning unrestricted Certificates for restricted categories.
