• currently live and be settled in the UK, or • be coming to live permanently in the UK, and • not be under 21 years of age.
Spouses or civil partners
Applicants must be able to show that:
• they are legally married to each other or are in a civil partnership which is recognised in the UK • they intend to live together permanently as husband and wife or as civil partners • they have met each other previously • they are able to support themselves and any dependants without recourse to public funds • they have suitable accommodation in the UK which is owned or rented by them for use by their household and where they can live without recourse to public funds • they are over the age of 21.
If your application is successful you should be granted permission to come to the UK for an initial two year period. During this time you should be allowed to undertake employment. Towards the end of this period it should be possible for an application for permanent residency (Indefinite Leave to Remain ILR) to be made, provided you are still married and living together and intend to remain so.
Fianc£, fianc£e or proposed civil partners
Applicants must be able to show that:
• they plan to marry or register a civil partnership within a reasonable time (normally six months) • they plan to live together permanently after the marriage or partnership ceremony • they have met each other previously • they are able to support themselves and any dependants without recourse to public funds • they have suitable accommodation in the UK which is owned or rented by them for use by their household and where they can live without recourse to public funds • they are over the age of 21.
If your application is successful you should be granted permission to enter the UK for a period of six months, during which time you will not be able to undertake employment.
Once you have married or registered a civil partnership you should be able to apply to extend your stay in the UK for a period of two years and if successful you will also be granted permission to undertake employment. At the end of this period an application for ILR (permanent residency) may be made however applicants will need to pass a £Life in the UK£ test.
Unmarried spouse or same-sex partnership
In order to be eligible to apply to enter the UK as the unmarried spouse or same sex partner of a person present and settled in the UK or of someone who is coming to live permanently in the UK applicants must show that:
• any previous marriage, civil partnership or similar relationship has permanently broken down • they have been living together in a relationship similar to marriage or civil partnership for two years or more • they are able to support yourselves and your dependants without recourse to public funds • they have suitable accommodation which is owned or rented by them for use by their household and where they can live without recourse to public funds • they intend to live together permanently • they are over the age of 21.
When making an entry clearance application, applicants must provide evidence of a two-year relationship. This may include:
• documentation evidencing joint commitments, such as bank statements, investments, mortgage or rent agreements • correspondence addressed to both parties at the same address together with official records such as utility bills etc.
If successful, applicants will be granted an initial permission to stay and work in the UK for two years. At the end of this period, provided you are still partners and intend to continue to live together, an application for ILR (permanent residency) may be made. Applicants will need to pass a 'Life in the UK' test. Dependant children It is possible to apply for dependant children to join holders of the above visas in the UK. Dependant children are considered to be:
• under the age of 18 • unable to support themselves financially and are not married or in a civil partnership and are not living independently away from their parents.
